Minimum Wage
The monthly minimum wage varies depending on job role and industry. It can range between 13,572.90 KES to 30,627.45.
Working Hours
Standard Working Hours
The standard working hours is 45 hours a week. The standard work week is Monday – Friday.
Overtime
Any working hours above the standard 45-hour work week is considered as overtime. The total working hours cannot exceed 56 hours, and overtime per day should not exceed 4 hours. Overtime is usually paid at the rate of 150% of the employee’s regular salary.

Leave
Paid time off
An employee is entitled 21 days annual leave which is granted after one year of service. New employees are eligible for annual leave after their 7th month with their employer.
Sick Pay
Employees are eligible for sick leave after 2 months of service. For the first 7 days, 100% of salary is paid and after this time is halved for the next additional 7 days.
All sick leave requires a medical certificate by a medical professional.
Maternity Leave
Women are entitled to at least 3 months maternity leave at 100% of their salary rate. The employee must notify their employer at least 7 days before taking leave an provide a medical certificate.
Paternity Leave
Fathers in Kenya are entitled to 2 weeks of 100% paid paternity leave.
Termination
Termination of Employment
Employers have the authority to end a fixed-term contract based on specific grounds, which include business-related reasons, personal considerations, or worker misconduct.
This process mandates a written notice along with a written justification for the termination. In instances where misconduct is the basis for termination, the employee must first receive a warning and an opportunity to clarify their actions.
In the case of the employee is being made redundant, they are entitled to severance pay equal to 15 days salary of every year worked.
Notice Period
The notice period is dependent on the job role and length of employment. The notice period is typically 28 days, however, if the employee terminates the contract in the probation period the notice period is just 7 days.
Probation Period
The standard probation period in Kenya in 3 to 6 months.
